FSVP Puts the Obligation on the Importer

This is the structural difference between shipping to the US and shipping to the EU, and it surprises first-time importers. Under the Food Safety Modernization Act's Foreign Supplier Verification Programs rule, you as importer of record must verify that your foreign supplier produces food to a standard equivalent to US requirements — and keep the records that prove you did.

Alongside that: the facility must be registered with the FDA, and Prior Notice must be filed before the shipment arrives. Neither is onerous, but both are hard deadlines rather than paperwork you can catch up on.

What the FDA Looks For in Spices

Salmonella is the dominant microbiological concern for imported spices and the most common cause of detention. The FDA also applies defect action levels covering foreign matter, and screens for heavy metals and, in ground product, undeclared colouring.

Every batch we ship carries third-party results covering microbiological load, moisture, ash, heavy metals and aflatoxin, plus curcumin for turmeric or heat and colour for chilli. Chilli additionally carries Sudan dye screening. A supplier who can hand you those records per batch turns your FSVP file from an annual scramble into a filing exercise.

Stated plainly: we do not currently hold organic certification, so nothing we supply may be marketed as USDA Organic. Verification requirements also vary with your hazard analysis, so confirm what your FSVP requires with your own regulatory adviser.
